Terms of service

These terms are between you and Oscar Ivan Tigreros Bolanos, trading as Breakpatch (“Breakpatch”, “we”), and cover Breakpatch Team and Business licences, and Solo licences, bought on breakpatch.dev once those plans are offered. None of them is on sale yet: Team and Business are coming later, and their prices aren't decided. Breakpatch Community is free and open source under the Apache License 2.0; that licence, not these terms, covers it.
Who sells it
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns: payments, invoices, tax and refunds. For help using Breakpatch itself, email support@breakpatch.dev. You can send a refund request to Paddle or to us: see the refund policy. Paddle's buyer terms apply to the purchase itself.
The licence
- A licence has a number of seats for people and machine licences for local runner Macs and CI machines. Team includes 1 machine licence and Business 5; you can buy more.
- Solo, when offered, is for one person, used on one Mac at a time, with 1 machine licence and no extra ones. It's one Solo per company: everyone with an email address at the same company domain shares that one place, so a second person there needs Team. A Solo bought with a personal email address (such as Gmail or iCloud) counts for that address only. If a second Solo is bought for a company that already has one, we refund it or move it to Team.
- A machine licence covers one test run at a time on any machine; a pipeline running N jobs in parallel needs N licences.
- One seat is for one person. The same person on another Mac keeps the same seat. Don't share a seat between people.
- Keep the licence key private to your organisation. If it leaks, email us and we replace it.
- A subscription renews at the end of each billing period (monthly or yearly) until you cancel. Cancel before the renewal date to avoid the next charge; renewal payments aren't refunded, and a cancelled licence ends at the end of the period already paid. Adding or removing seats or machine licences is charged or credited straight away, pro rata for the rest of the billing period; credits go against your next payments.
- When you cancel, the licence keeps working until the end of the period you paid for. After that, Breakpatch keeps working as Community and the paid features are off. Your tests stay where you keep them: in your tests folder, or in your own Firebase project.
- If a payment fails, Paddle tries again. The licence keeps working for 7 days past the end of the paid period while it does.
The licence check and usage counts
Breakpatch Solo and Team check the licence with our licence service when they open and about once a day. Usage counts are part of that check: every check from the app and from breakpatch-ci sends, per seat or machine, how many tests were created and runs made (by hand, from schedules, on the local runner and in CI, passed and failed) and on how many days Breakpatch was used. Your admins and Breakpatch see them in the back office. Nothing from inside a test is sent: no test names, addresses, steps or screenshots. There is no switch for them in Solo or Team. Your data
Your tests, runs and workspace live in the Firebase project you connect, which you own and control, or, on Solo without a workspace, in a folder on your Mac. We don't host them and can't read them.
The exception, once it's offered, is Hosted by Breakpatch: it keeps a Team or Business workspace for you, in Europe, with your tests encrypted on your Macs by a key we never have, so we store them but can't read them. We see only what the workspace needs to work, such as who is in the team, dates, pass or fail and counts.

Warranty and liability
Breakpatch is provided "as is". We work to keep it reliable and fix problems quickly, but we can't promise it will be free of errors or catch every problem in the software you test. You remain responsible for your own releases.
Our total liability to you under a licence is limited to what you paid for that licence in the 12 months before the claim. We aren't liable for indirect losses, such as lost profit, lost data or business interruption. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing takes away rights you have as a consumer.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you're a consumer living elsewhere, you keep the protections of the law where you live and can bring a claim there.
Changes
We may update these terms. For a change that affects a paid licence, we email the licence's admins at least 30 days ahead; the terms in force when your current period started apply until it ends.
